Khaitan & Co successfully represented Bling Brands Private Limited, proprietor of the well-known fitness and wellness brand "BOLDFIT", in a trademark infringement and passing off action before the High Court of Delhi. The suit was instituted against a partnership concern, Bold Fitness, using the deceptively similar marks “BOLD FITNESS” / “BOLDFITNESS” in relation to identical goods, namely gym and athleisure wear. Upon hearing detailed submissions, the Court was pleased to grant an ex parte ad interim injunction in favour of the Plaintiff, restraining the Defendant from using the impugned marks. In addition, the Court appointed a Local Commissioner to conduct a search and seizure operation at the Defendant’s premises. The order secures robust protection for client’s trademarks.
