Husky Group - Anti-dumping duty investigation

Khaitan & Co successfully advised and represented manufacturing and exporting entities viz; (i) Husky Injection Molding Systems SA., Luxemburg (ii) Husky Injection Molding Systems Shanghai Ltd., China (iii) HUSKY INJECTION MOLDING SYSTEMS LTD., CANADA (iv) Husky Injection Molding Systems India (Pvt.) Ltd. (“Husky Group”)  before the Directorate General of Trade Remedies (“DGTR”) in the Anti-dumping investigation concerning on import of “Plastic Processing Machinery” originating in China and Taiwan and exported from any country including China PR and Taiwan and secured 0% or ‘nil’ rate of anti-dumping duty for 5 years. The DGTR conducted an anti-dumping investigation to assess dumping of plastic processing machinery into India and recommend imposition of anti-dumping duties to counteract dumping which remain in force for 5 years.

All interested parties are required to participate in the proceedings, submit questionnaire responses, data, records, present submissions and make arguments before the Authority. In case of successful representation, exporters secure individual duty rates specific to the level of dumping or injury calculated based on their submissions while unsuccessful or non-participating exporters are levied with a ‘residual’ rate which is a country wide rate.

The team provided representation to the Husky Group on all aspects of the proceedings including submission of questionnaire responses, data, submissions and appearing before the DGTR in hearings and based on the advice and representation provided to Husky Group by the team, the DGTR assessed and notified ‘nil’ rate of duty on exports of plastic processing machines exported from China by the Husky Group for the next 5 years. Following the decision of the DGTR, the Central Government has now notified imposition of anti-dumping duties vide Notification No. 21/2025 Customs (ADD) confirming ‘nil’ anti-dumping duty on exports of plastic processing machinery by Husky group from China to India.

This has a significant impact on the operations of the Client as the anti-Dumping Duty (ADD) on other exporters from China range from 48%- 63% and Husky Group is the only interested party from China to obtain ‘nil’ rate of anti-dumping duty.
