Khaitan & Co advised Galderma Holdings S.A., acting in India through Galderma India Pvt Ltd (‘Galderma’) which has been facing significant challenges due to the increase in sale of counterfeit goods bearing its trademarks ‘CETAPHIL’, on the e-commerce platforms as well as in local markets. On 18 June 2025, the Bombay High Court granted Galderma a John Doe order, which allowed Galderma to conduct search and seizure operations. Following the order, Galderma’ and Khaitan & Co. team (‘KCO’), with the support of the police and Court Receivers, successfully executed simultaneous operations on 2 July 2025 in New Delhi and Mumbai.
In New Delhi, a manufacturing unit was raided and the team confiscated over 15,000 finished and unfinished goods, along with over 12,000 bottle caps, approx. 6000 stickers bearing the ‘CETAPHIL’ mark and raw material. The counterfeiters were also found to produce counterfeit items for other major brands. In Mumbai, several premises were searched at Crawford Market. However, owing to the location only few counterfeit products could be seized.
