Madras High Court Bars Karnataka Restaurant From Exploiting the ‘TVS’ Brand Identity

TVS Holdings Ltd. and TVS Motor Company Ltd. ("TVS") have secured a significant trademark victory against "TVS Bar and Restaurant" in Karnataka, reinforcing the strength and distinctiveness of the TVS brand. What made the infringement particularly egregious was not merely the adoption of the name "TVS", but also the use of a strikingly similar font and stylization that closely mirrored TVS's well-established trade dress.

Recognizing the clear attempt to ride on the goodwill and reputation built by TVS over decades, the Madras High Court, by its order dated 10 July 2026, held that the mark "TVS Bar and Restaurant" was deceptively similar to TVS's trademark both visually and phonetically. The Court consequently granted an ex parte injunction, underscoring its commitment to protecting brands from misappropriation and consumer confusion.
